There are some general rules of who is at fault based on traffic laws:
- When two vehicles approach the intersection and come to a stop at the same time, the vehicle on the right has the right of way before the vehicle on the left.
- Any vehicle wishing to turn left at an intersection must yield to all other traffic and pedestrians until safe to turn.
- Vehicles entering rotary intersections must yield to all other vehicles already in the rotary until safe to enter.
- Motorists may turn right on red after coming to a complete stop and must yield to oncoming traffic while merging, unless the intersection specifically states so.
However, there are always exceptions to these rules. Sometime proving what happens requires have an investigator obtain surveillance of an area to determine fault in an accident. It may require a court hearing to confront the other driver about how the accident occurred or obtaining cell phone records from the other driver showing they were distracted at the time of the accident.
